1. General terms and conditions

These General Terms and Conditions apply to all guest contracts concluded between Basement-Rotherbaum GmbH in Hamburg with third parties (overnight guest). Our agreements are visibly displayed in our premises and are available for the guest’s knowledge. By this fact alone, they are sufficiently brought to the attention of the customer, the parties to the rental agreement, as well as third parties within the meaning of the provisions of the german civil code BGB.

2. Reservations

The guest has the possibility to reserve a room for 24 hours without obligation. The Basement-Rotherbaum reserves the right to rent the reserved rooms to other parties after the expiration of the reservation, i.e. after 24 hours.
A binding reservation of a room requires a deposit of 30% of the invoice amount for bookings made up to 14 days before the date of arrival. This deposit must be paid within the first 8 days after receipt of the booking confirmation. Should this not happen, the Basement-Rotherbaum reserves the right to cancel the now no longer valid booking and to assign the room to someone else.
If the booking is made less than 14 days before the date of arrival, the acceptance of the offer by the guest results in a binding accommodation contract for both parties. The guest has no right to overnight accommodation for room reservations not confirmed by the guest. There is no claim to an overnight accommodation service in a certain room.

3. Guaranteed bookings, cancellation periods

A guaranteed booking exists only if the guest has confirmed the booking by e-mail and has paid the deposit according to 2. Reservations. In case of non-appearance of the guest without cancellation, the full invoice amount will be charged minus any saved expenses. The same applies to cancellations on the day of arrival. In case of cancellation 14 days or less prior to arrival, the guest’s deposit will be retained. In the event that no deposit has been paid, at least 30% of the invoice amount will be charged. If a guest shortens the booking within his stay, the full invoice amount is to be paid. The Basement-Rotherbaum reserves the right to cancel bookings made six months in advance, calculated from the date of booking, without compensation. Any deposits paid will be refunded.

4. Prepayment of the price of the overnight stay

The price of the entire booked overnight service is to be paid in advance by the guest at the latest upon arrival at Basement-Rotherbaum. In case of early departure, the guest has no right to a refund of the remaining amount.

5. Means of payment

Payment shall be made by debit or cash payment in Euro. Only in case of a written confirmation a bank transfer of the invoice amount can be made.

6. Use of booked rooms

Booked rooms are available to the guest from 2 pm on the day of arrival until 11 am on the day of departure.

7. Liability risks of the guests for brought objects

The guesthouse is not the custodian of the items brought into the room by the customer and is therefore not liable for their fate. This applies in particular to so-called valuables. It is expressly pointed out that the Basement-Rotherbaum does not offer the possibility of storage in a guesthouse safe or similar security containers. The guest therefore brings in such items at his or her own risk. The Basement-Rotherbaum is also not a custodian for luggage left in the guesthouse, which is left in the guesthouse after vacating the rooms and is picked up later.

8. Non-smoking in the pension

We are a non-smoking pension. Therefore, it is forbidden to smoke in the guest rooms. In case of violation, the Basement-Rotherbaum has the right to charge the guest with the corresponding cleaning costs, as well as with the rental losses resulting from the non-renting of the room.

10. Additional agreements / written form requirement

Changes or additional agreements must be made in writing in order to be effective. The same applies to the waiver of the written form requirement.

11. Place of jurisdiction

The place of jurisdiction for all disputes arising between the parties from the contractual relationship is Hamburg, insofar as the contractual partner of Pension Basement-Rotherbaum is a merchant or legal entity.
